Are the sellers responsible if termites are found?

I am living in the house that I bought for a year now. It's located in Boise, Idaho. As of the moment, I am having problems regarding termites. The inspector said there is damage from long term termite infestations. What are the terms of the pest inspection? Are the sellers responsible if termites are found? What should I do?
